Principal Claims to Have Secretly Video-Recorded Students in the Bathroom

Robert Burke, age 43, from Dubuque, Iowa, has been charged with one count of receipt of child pornography. The charge is contained in a Complaint filed today in United States District Court in Cedar Rapids.

The Complaint alleges that, between about January and June 2011, Burke used a computer and the Internet to receive images of child pornography. The Complaint alleges that, on April 10, 2011, an FBI agent in Washington D.C., downloaded eight depictions of child pornography from a computer that was later traced to Burke’s residence.

The Complaint also alleges Burke is the principal at Sageville Elementary School in Dubuque County. The Complaint further alleges that, during an interview on June 3, 2011, Burke stated he had placed a hidden video camera in a boys’ bathroom at this school, and the camera had produced video images of students who were using the bathroom. Burke allegedly stated he had not touched any children in a sexual manner. The Complaint alleges law enforcement agents have not had the opportunity to perform a forensic examination of Burke’s computer and other electronic evidence seized on June 3, 2011, and the government does not, at this time, have evidence to contradict Burke’s statement that he had not touched any children in a sexual manner.

If convicted, Burke faces a mandatory minimum sentence of 5 years’ imprisonment and a possible maximum sentence of 20 years’ imprisonment, a $250,000 fine, a $100 special assessment, and supervised release following any imprisonment for at least 5 years and up to life.

Burke’s first appearance in federal court in Cedar Rapids for an initial appearance is set for today at 4:00 p.m.

As with any criminal case, a charge is merely an accusation and a defendant is presumed innocent until and unless proven guilty.

The case is being prosecuted by Assistant United States Attorney Mark Tremmel and is being investigated by the Federal Bureau of Investigation, the Iowa Division of Criminal Investigation, the Iowa Internet Crimes Against Children Task Force, and the Dubuque County Sheriff’s Office.

Robert Burke, age 43, from Dubuque, Iowa, has been charged with production, distribution, receipt, and possession of child pornography. The charges are contained in an indictment filed today in United States District Court in Cedar Rapids.

The indictment alleges that, between January and June 2011, Burke used minors to produce visual depictions of their genitals without the minors’ knowledge. It also alleges that Burke received depictions of child pornography using the Internet, that he distributed child pornography he had obtained from the Internet, and that he possessed four hard drives containing child pornography.

A complaint filed last month alleges Burke is the principal at Sageville Elementary School in Dubuque County. The Complaint further alleges that, during an interview on June 3, 2011, Burke stated he had placed a hidden video camera in a boys’ bathroom at this school, and the camera had produced video images of students who were using the bathroom. The complaint alleges Burke stated he had not touched any children in a sexual manner.

If convicted, Burke faces a mandatory minimum sentence of 15 years’ imprisonment and a possible maximum sentence of 110 years’ imprisonment, a $1,750,000 in fines, $700 in special assessments, and supervised release following any imprisonment for at least five years and up to life.
Burke’s arraignment on the indictment in federal court in Cedar Rapids is set for July 13 at 12:00 p.m.

The former principal of Sageville Elementary School in Dubuque, Iowa, who produced child pornography by secretly videotaping students at the school, pled guilty today in federal court in Cedar Rapids.

Robert Burke, age 43, from Dubuque, Iowa, was convicted of one count of producing child pornography. In a plea agreement, Burke admitted that, between January 2011 and June 3, 2011, while he was principal at Sageville Elementary School, he used cameras, including hidden cameras in the school bathroom, to take videos depicting the lascivious display of the genitals of unknowing male students at the school. Burke admitted he saved these videos on hard drives at his house in Dubuque.

Sentencing before United States District Court Chief Judge Linda R. Reade will be set after a presentence report is prepared. Burke remains in custody of the United States Marshal pending sentencing. Burke faces a mandatory minimum sentence of 15 years’ imprisonment and a possible maximum sentence of 30 years’ imprisonment, a $250,000 fine, a $100 special assessment, and supervised release for 5 years to life following his imprisonment.

CEDAR RAPIDS, IA—The former principal of Sageville Elementary School in Dubuque, Iowa, who produced child pornography by secretly videotaping students in the boys’ bathroom at the school, was sentenced today to 30 years in federal prison.

Robert Burke, 43, from Dubuque, Iowa, received the prison term after an Aug. 2, 2011, guilty plea to one count of producing child pornography.

In a plea agreement, Burke admitted that, between January 2011 and June 3, 2011, while he was principal at Sageville Elementary School, he used hidden cameras in the school bathroom to secretly capture videos depicting the genitals of male students at the school. Burke admitted he saved these videos on hard drives at his house in Dubuque.

According to a previously filed criminal complaint, law enforcement officers were alerted to Burke after an FBI agent in Washington, D.C., downloaded eight images of child pornography from a computer that was later traced to Burke’s residence. On June 3, 2011, federal, state and local law enforcement officers executed a search warrant at the residence. During an interview, Burke said he had placed a hidden video camera in a boys’ bathroom at this school and recorded students who were using the bathroom.

According to information disclosed in court, Burke has claimed he has not touched any children in a sexual manner, and the government has gathered no evidence to contradict Burke’s claim.
Also according to information disclosed in court, investigators recovered evidence of an online chat where Burke told another person that he had captured depictions of “some boys peeing at urinals” and offered to make the depictions available for sharing. A forensic examination of Burke’s computer equipment revealed no evidence that Burke shared the videos he produced at the school.

Burke was sentenced in Cedar Rapids by U.S. District Court Chief Judge Linda R. Reade to 360 months’ in prison and fined $25,000. A special assessment of $100 was imposed. He must also serve a 20-year term of supervised release after the prison term. There is no parole in the federal system.
“As an elementary school principal, Burke was in a position of trust and authority over his students,” said U.S. Attorney Rose. “He took advantage of that trust, and he used his position of authority to exploit the children he was supposed to protect. Although Burke victimized many young children and caused tremendous concern to the entire community, the harm in this case might have been even worse had law enforcement not intervened when it did. The federal, state and local law enforcement officers whose excellent work put a stop to Burke’s criminal behavior should be commended, as should the school administrators, educators and parents whose assistance in this case was invaluable.”

Burke is being held in the U.S. Marshal’s custody until he can be transported to a federal prison.
