    Frankfort-Schuyler teacher guilty of touching ex-student, 15

    19 December 2013

A Frankfort-Schuyler middle school teacher has been found guilty of sexually touching one of his former students when she was 15, prosecutors said.

Michael Loiacano, a seventh-grade English teacher, was convicted Wednesday night of forcible touching and endangering the welfare of a child, both misdemeanor charges, after an all-day trial in Herkimer Town Court, Herkimer County District Attorney Jeffrey Carpenter said.

Loiacano's punishment will not be known until he is sentenced at 1:30 p.m. on March 11 by town Justice Karl Manne. Loiacano will have to register as a sex offender, prosecutors said, and the possible punishments he could face range from up to one year in jail to three years of probation and a fine.

Loiacano was placed on administrative leave after he was accused in August of touching the private parts of the former female student in a school classroom sometime between December 2010 and January 2011, Carpenter said.

Loiacano, who was represented by attorney Les Lewis, denied the allegation at trial.

After the jury's verdict, Frankfort village police Chief Ronald Petrie said he believes the teacher's conviction sends an important message to the public.

"I think it's important for any young female victims to come forward, report allegations of this type and let the system work for them," Petrie said Thursday. "This shows that the system does work and will back up the victims of sex abuse."

    Teacher terminated in Frankfort-Schuyler district

    12 February 2014

The Frankfort-Schuyler school board voted Tuesday to terminate the employment of a tenured teacher who was found guilty of sexually touching a former student when she was 15.

Michael J. Loiacano, a seventh-grade English teacher, was convicted in December of forcible touching and endangering the welfare of a child, both misdemeanor charges, after an all-day trial in Herkimer Town Court. He was accused of touching the private parts of the former female student in a school classroom sometime between December 2010 and January 2011."Whenever a tenured educator is convicted of a sex offense, the Education Law requires the employing board of education to terminate the educator's employment without a tenure hearing," School Superintendent Robert Reina said in a written statement. "The board's action was effective immediately."Loiacano, who was represented by attorney Les Lewis, denied the allegation at the trial. The district placed the teacher on paid administrative leave after charges were brought against him last August, Reina said. Loiacano was not permitted to return to his teaching assignment and had not been on school property since that time, he added. He said the board had to follow due process in the matter.

Loiacano is scheduled to be sentenced at 1:30 p.m. March 11 by town Justice Karl Manne. Prosecutors said he will have to register as a sex offender and could face from up to one year in jail to three years of probation and a fine.
His arrest followed an investigation by the Frankfort Police Department and the Herkimer County Child Advocacy Center.

"The district thanks Herkimer County District Attorney Jeffrey Carpenter and Frankfort Village Police Chief Ronald Petrie for their diligence in pursuing the criminal case," Reina said in a written statement. "The district cooperated fully with their efforts. As always, the continued safety and well-being of our students remains our paramount concern."
