    Carlos Miguel Martinez, 45, was a first grade teacher at Northeast Independent School District's Montgomery Elementary School when the girl made an outcry of abuse last September. He resigned in March after being on administrative leave since October.


    "After we completed our investigation, we could not substantiate the allegations," said NEISD spokeswoman Aubrey Chancello. "There simply was not enough credible evidence to justify leaving the teacher out. So he was returned to the classroom." However, CPS's investigators felt otherwise, and notified the district that they felt the allegations were credible, and the district removed Martinez from the classroom again.

    WOAI: Former teacher charged with indecency with a child (May 2 2013)

    A former first grade teacher at Montgomery Elementary School in North East Independent School District is charged with indecency with a child. News 4 first reported back in September about a six-year-old girl who said her first grade teacher inappropriately touched her at school. Now, 45-year-old Carlos Miguel Martinez is charged for the alleged crime. "When I brought her home and she wouldn't stop crying, I asked her what was wrong. She told me she was uncomfortable with her teacher, she didn't like him," explained the girl's relative, when News 4 spoke to her almost eight months ago.

    Former first-grade teacher Carlos Martinez, 45, has been charged with indecency with a child by contact, in an alleged incident involving one of his 5-year-old students at Montgomery Elementary School in northeast Bexar County ... “A little girl claimed that this teacher had touched her inappropriately over her clothes,” Chancellor said ... Chancellor said even after the alleged victim was interviewed by NEISD police and a human resources staff member, her claims were not found to be credible. As a result, Chancellor said Martinez was reinstated nine days after being put on paid administrative leave ... However, more than a week later, Chancellor said he was placed on leave again after learning an investigation by Child Protective Services deemed the child’s allegations were credible.​
