A series of emails led authorities to a sexual relationship between a teacher [Brenda Ray] and her student, Rio Rancho police said ... The suspect was in her mid-30s at the time.The victim, who is now 20, told police he had sex with Ray multiple times during his junior year, police said. According to the criminal complaint, the victim’s ex-girlfriend found numerous emails to and from Ray between 2009 and this year and gave them to police. The victim said the two smoked marijuana, drank alcohol and even tried cocaine together, according to police.

Rio Rancher Observer (24 July 2011): Ex-local high school teacher charged with sex acts on student

Rio Rancher Observer said:

The allegations arose when [Brenda] Ray's former boyfriend told police he had discovered a series of emails between Ray and the student, a former Rams athlete. Ray and the student exchanged 47 emails between Dec. 14, 2009, and May 9, 2011, according to an arrest warrant affidavit. Many of Ray's emails included her Cleveland High School signature. During a recent interview at police headquarters, the student admitted to three separate incidents of sexual contact during the 2007-08 school year. The first occurred in her vehicle in a neighborhood close to the school after the two met at a school event. The second happened while parked at Haynes Park, and the final act occurred at his parents' home. During the interview, the student admitted that he also "has smoked marijuana and drank alcoholic beverages with Ms. Ray and that he has also tried cocaine with her," according to the affidavit. While the alcohol and drug incidents happened after he graduated, they still occurred before he was of legal drinking age.

Rio Rancho Observer (3 Feb 2012): Former teacher gets probation after sex with student

Rio Rancho Observer said:

Brenda Ray, 41, apologized before Circuit Judge George Eichwald for having sex with a former Rio Rancho High School student-athlete. The victim, who was younger than 18 at the time, did not appear at the brief hearing "and he made it clear he did not want her to be punished," said Assistant District Attorney Kevin Graham. Ray was given a 36-month, conditional discharge, with supervised probation during that period, as well as undergo counseling and perform 80 hours of community service.

KRQE said:

[Brenda] Ray pled guilty to the charges against her on Thursday and as part of her plea deal she was sentenced to three years probation. While prosecutors asked she have to register as a sex offender Judge George Eichwald gave her a pass. If Ray successfully completed her probation her record won’t show that she’s a convicted sex offender.
