    Inner House reverses tribunal decision that teacher who had indecent images on computer was unfairly dismissed

    The Inner House of the Court of Session has allowed an appeal by an employer against a decision of the Employment Appeal Tribunal to uphold grounds of appeal against a teacher’s dismissal following him being charged with possession of indecent images of children. The appellant employer, L, argued that the EAT had erred in concluding that the respondent, K, could only have been fairly dismissed if it could be proved that he had downloaded the images himself.     Appeal finds indecent image teacher dismissal was fair

    A teacher who had been suspected, but not charged, of possessing indecent images of children was fairly dismissed, the Court of Session in Scotland has ruled. The teacher, who cannot be named for legal reasons, had been arrested after the images had been found on his home PC. His son also had access to the computer and was also arrested, but charges against both were later dropped.     Teacher accused of possessing indecent pictures of children was fairly dismissed

    In L v K the claimant, a teacher, was charged but not subsequently prosecuted with possession of indecent images of children. Police Scotland officers attended at his home to carry out enquiries relative to an IP address linked to online indecent images. Subsequently he was charged with possession of a computer containing indecent images of children. His son, who lived with him, was similarly charged. Ultimately no criminal proceedings were brought against either of them. The teacher informed the headmaster of the school where he was employed as to what had happened.
