Lawyer For New Jersey Teacher In Student Sex Case Says It Was 'A Victimless Crime'

The lawyer for a former New Jersey teacher accused of having inappropriate relationships with high school students said Wednesday that his client committed “a victimless crime.” Nicole McDonough, 32, is charged with three counts of second-degree official misconduct for allegedly having improper relationships with three 18-year-old male students. She faces a mandatory sentence of five years in prison if convicted, which her attorney says is unjust. At a pretrial hearing, McDonough’s lawyer, Timothy Smith, said that three students with whom McDonough allegedly was involved “each said they have not felt victimized,” NJ.com reported. “If ever there was a victimless crime, ...

Teacher accused of official misconduct in sex case seeks rules violations by prosecutor's staff

The attorney for a suspended Mendham High School teacher accused of official misconductin a sex-related case is asking the Morris County Prosecutor's Office to release all records of rules violations by members of its staff within the past five years. Nicole McDonough, 32, of Mount Olive, is accused in three cases involving 18-year-old male students. Because she is being prosecuted based only on a violation of school district rules, she needs to know if any members of the prosecutor's staff have been charged with official misconduct because of violations of county or prosecutor work rules, attorney Timothy Smith said in ...

West Morris-Mendham teacher wants sex-related charges tossed

A defense lawyer Wednesday continued pressing for dismissal of an official misconduct indictment against a suspended West Morris Mendham High School teacher who is charged with having sex with one 18-year-old student and soliciting sex from two others. Morris County Assistant Prosecutor Christopher Schellhorn, meanwhile, argued to Superior Court Judge Stephen Taylor against dismissal of the indictment against Nicole McDonough and said she is welcome to try to convince a jury that sex and sexting with three 18-year-old males was not an “unauthorized act” related to her job as a teacher. “That’s an excellent trial defense if she wants to ...

Judge Denies Personnel Records Request in Mendham Teacher Sex Case

Telling a defense attorney that his request to "rummage" through more than 100 prosecutor's office employees' personnel files to back up his own case was without merit, a judge denied the motion in court Wednesday in a case involving a Mendham High School teacher accused of having sex with a student. Judge Stephen Taylor rejected the request, according to nj.com, in the case of Nicole McDonough, who was indicted for having sexual relations with an 18-year-old student in 2014 and "improper fraternization" with two other 18-year-old students in 2013. McDonough was formally charged with three counts of official misconduct and ...

Prosecutor: Ex-Mendham teacher sent sexy pics to students

A judge Thursday refused to dismiss an official misconduct indictment or to suppress evidence seized with a search warrant at the home of a former West Morris-Mendham High School teacher who is accused of abusing her position by having intercourse with one adult student and sexting via Snap Chat and Instagram with two others. Superior Court Judge Stephen J. Taylor, sitting in Morristown, released a written decision that denied defense lawyer Timothy Smith's motion to dismiss an indictment that charges Nicole L. McDonough, 34, of Mount Olive, with three counts of official misconduct. Smith had contended that McDonough could not ...

Judge won't drop charges against N.J. teacher in sex case

A Superior Court judge on Thursday refused to dismiss official misconduct charges against a suspended Mendham High School teacher accused of having sex with an 18-year-old male student and improperly fraternizing with two others. Rejecting defense attorney Timothy Smith's contention that the charge was "overreaching" because the students were consenting adults and the teacher, Nicole McDonough, 32, of Mount Olive, only violated a school board policy, Judge Stephen Taylor ruled that the prosecution had satisfied all the requirements for an official misconduct charge. Because the students were 18 and adults, McDonough was not charged with a sex crime. Taylor released ...

Charges Won't Be Dropped In Mendham Teacher Sex Case: Report

A motion to dismiss charges of official misconduct against a Mendham High School teacher alleged to have engaged in sexual relations with a male student and "improperly fraternizing" with two others was denied Thursday by a judge in Superior Court in Morristown. Judge Stephen Taylor made the decision, along with allowing evidence seized from the home of Nicole McDonough, 32, of Mt. Olive, nj.com reported. McDonough was arrested Dec. 30, 2014 and subsequently suspended from her position as an English teacher at Mendham High School. The trysts allegedly took place in the spring of 2014, while the improper communication with ...

Misconduct charges to be heard against Mendham High teacher

Charges of official misconduct will not be dismissed against a Mendham High School teacher who is alleged to have had sex with an 18-year-old student and with having improper relations with two other students. A Superior Court judge in Morristown issued the ruling on Thursday, Nov. 19, regarding the suspended teacher, Nicole McDonough 32, of Mount Olive. She is accused of having sex with an 18-year-old student and with having improper communications with two other students. GUILTY
A former English teacher for West Morris Mendham High School pleaded guilty Tuesday to official misconduct by violating school policy and twice having sex with an 18-year-old student in 2014.
Nicole McDonough, 33, of Mount Olive, had been facing a state prison term but Morris County Assistant Prosecutor Christopher Schellhorn and defense lawyer Timothy Smith negotiated a deal under which McDonough admitted Tuesday to one count of official misconduct and simultaneously was accepted by Superior Court Judge Stephen Taylor into Morris County's Pre-Trial Intervention program for first-time offenders.
Under PTI, McDonough will be supervised on probation for three years. She has agreed to forfeit her teaching certificates and is forever barred from seeking future public employment in New Jersey.
She was never specifically charged with a sex crime because the students all were adults. She pleaded to only one count of official misconduct and the other two counts will be dismissed as part of the plea agreement.
If McDonough successfully completes three years' probation, the official misconduct charge will be dismissed and she will not have a criminal record. If she violates probation, she faces sentencing of up to 10 years in prison on her guilty plea to official misconduct.
