Child Victims Act 'day of reckoning' looms for diocese, Scouts – and schools

She was making a pot of beef and barley soup in 2013 when her phone rang. It was a detective from the Niagara Falls police. A woman had told police she was sexually abused many years earlier by a Niagara Falls City School District teacher, and that there may have been other victims. The detective asked the woman making soup if she was one of them. “I dropped an entire bottle of parsley in the pot I was so shocked,” said the woman, who asked that her name not be published. She says her music teacher, Patrick Kuciewski, began sexually ...

Child sex abuse victims can now file claims regardless of timeframe

No matter how much time has passed, on Wednesday people sexually abused as children will be able to sue the person or organization that holds responsibility. Under the New York State Child Victim’s Act, victims will have one year to file a claim, with no statute of limitations. Just hours before the law goes into effect, lawyers throughout the state announced lawsuits ready to be filed. Stacy Benson with Jeff Anderson and Associates says, “The courthouse doors are open. This is something that has been long awaited for 12 long years, at least in the New York Legislature. Thank you ...

Flurry of suits emerge as NY opens door to old abuse claims

The Roman Catholic Church, the Boy Scouts, schools and hospitals, the late financier Jeffrey Epstein are some of the targets named in a flurry of sex abuse lawsuits filed Wednesday in New York as the state began accepting cases once blocked by the statute of limitations. Hundreds of lawsuits were filed as plaintiffs rushed to take advantage of the one-year litigation window, created by state lawmakers this year to give people who say they were victims a second chance to sue over abuse that, in many cases, happened decades ago. Those suing Wednesday include a woman who says she was ...

Ex-Buffalo Public Schools teacher named in Child Victims Act lawsuit

A Buffalo Public Schools science teacher was accused of sexually abusing a student in the only Child Victims Act filed so far against the district. A Hamburg man alleges he was abused as a teenager by teacher Robert Sewast from 1980 to 1982, according to a lawsuit filed Wednesday. Sewast was accused of abusing the plaintiff about five times a week for about two years when the boy was 14 and 15. The court papers do not identify the school where the abuse allegedly occurred. Sewast forcibly touched the teen and exposed himself to him, according to the lawsuit. The ...

Foss: Take claims of child sexual abuse seriously

I spent my college summers working at a youth camp, and my training covered a lot of ground. Most of it was fun -- game playing, and bonding and program development -- but some of it wasn't. One of our graver discussions concerned sexual predators -- what to do if we received a report that an adult had abused a child in some way, how to spot and deal with inappropriate behavior. At the time, I viewed sexual abuse as terrible but rare -- something that could occur in a summer camp environment, but probably wouldn't. Now that I'm older, ...

Niagara Falls SD named in abuse suit

The first lawsuit filed under the Child Victims Act against a public school district in Niagara County was submitted to the court system Tuesday. The lawsuit alleges that between 2002 and 2003 certain officials in Niagara Falls City School District knew of allegations against a sexually abusive music teacher at Gaskill Middle School, Philip R. Sims, but did not immediately report the allegations to law enforcement when they became aware of the incidents. By inaction, the district failed in its responsibility under the law to protect students from a dangerous situation, the court filing said. Sims was arrested by local ...
