    The judge in this case, 13th Judicial District (Department No. 5) Judge G. Todd Baugh, is a real piece of work, a throwback to the dark ages, a Neanderthal who needs to be removed from office without delay, who based this ridiculously light sentence on his fantasy that somehow this fourteen-year-victim was "in control of the situation" and "older than her chronological age". This bozo clearly is unfit to be sitting on the bench.

    A Yellowstone County district judge Monday ordered a former Senior High teacher convicted of raping a 14-year-old female student who later committed suicide to spend 30 days in jail. Judge G. Todd Baugh sentenced Stacey Dean Rambold to 15 years in prison, with all but 31 days suspended, for sexual intercourse without consent ... The judge's sentence was not received well by the girl's mother, who repeatedly screamed "You people suck!" and stormed out of the courtroom.​

    Rambold pleaded guilty to the single felony charge in April in a case that began in 2008, when school officials and police first learned of the sexual relationship between Rambold and the girl, Cherice Moralez . Rambold was placed on paid leave in April of that year and resigned from his teaching job three months later. He also surrendered his teaching certificate. In October 2008, prosecutors charged Rambold with three counts of sexual intercourse without consent, alleging that the then-49-year-old man had an ongoing sexual relationship with Moralez, who was 14 at the time. While the case was pending, and a few weeks before her 17th birthday, Moralez took her own life.​

    One really has to wonder where the clock is set in Yellowstone County, Montana. Raping a 14-year-old girl who subsequently commits suicide nets the pervert a mere month in the hoosegow (not counting the suspended portion of the sentence), but abusing horses gets you put away four times as long?

Yellowstone County District Judge G. Todd Baugh instead sentenced Rambold to 15 years with all but 31 days suspended, the Billings Gazette reported. The judge knocked off another day for time served. Auliea Hanlon, the girl’s mother, shouted “You people suck!” as she stormed out of the courtroom, the paper reported.

    The judge also said Moralez was "older than her chronological age." The case also resulted in a $91,000 wrongful-death settlement between School District 2 and Moralez' family, who filed a civil lawsuit against the district.

In part because Moralez' suicide disrupted their case, the Yellowstone County District Attorney's office reached an agreement with Rambold delaying prosecution for three years. If Rambold completed a sex offender program during that time, charges would be dismissed. As part of that agreement, Rambold admitted to one of the rape charges, knowing that the admission could be used against him. Last November, Rambold was expelled from his sex offender program after his supervisor learned “he had been having unsupervised visits with minors and had not informed his counselors that he had been having sexual relations with a woman.” Prosecutors reintroduced the case last December, after learning of Rambold's dismissal from the program.

    Faced with backlash over his comments and the sentence that protesters considered too light, [District Judge G. Todd] Baugh wrote an apology in a brief letter to the editor in the Billings Gazette. The newspaper gave the Associated Press a copy of the apology. "I'm not sure just what I was attempting to say but it did not come out correct," he wrote. "What I said is demeaning of all women, not what I believe and irrelevant to the sentencing. My apologies to all my fellow citizens."

Under Montana law, children younger than 16 cannot consent to sex, and it’s considered statutory rape. The girl’s mother responded, "She wasn't even old enough to get a driver's license. But Judge Baugh, who never met our daughter, justified the paltry sentence saying she was older than her chronological age. I guess somehow it makes a rape more acceptable if you blame the victim, even if she was only 14."

Baugh described the girl as a troubled youth who "was probably as much in control of the situation" as was Rambold. "We think the sentence is a travesty," said Marian Bradley, president of the state chapter of the National Organization for Women, adding that the group was seeking his resignation.
    Referring to the judge, she added, "We think the man needs to be quiet before he endangers other women by suggesting they are to blame for being sexually assaulted." The women's group expected hundreds of people to attend a silent protest near the judge's offices on Thursday afternoon. Meanwhile, an online petition seeking Baugh's ouster had been signed by more than 13,000 people by Wednesday afternoon.

In the letter, attorneys argue the relevant statue was "misapplied and the minimum sentence that could be imposed in Rambold's case was two years."

    As prosecutors weigh a possible appeal, hundreds of protesters rallied at a Billings courthouse Thursday, demanding the judge step down.
