Tinch, who was a Class 3 instructor, had been under suspension without pay since August 29 after JCPS said he had sexual intercourse with an Iroquios student. He started August 15, and on August 29th a 16-year-old student accused him of having inappropriate contact with her. She claimed she began seeing him several months before he started his job ... Tinch told investigators he didn't know the girl, but JCPS says his phone records prove otherwise. According to the investigation, Tinch and the student exchanged more than 100 text messages and had 13 phone conversations that lasted an average of 30 minutes. On November 17th, the district decided to fire him.

Tinch and the girl had met about three months earlier when Tinch introduced himself to her at a gas station and offered her a ride to a friend’s house, according to an investigation report by the district. The report said the girl told Tinch she was 17 and would soon be turning 18, and the two exchanged phone numbers.

Joshua Tinch, who worked in the Iroquois High School suspension reduction program for special needs students, did not know the Iroquois student who alleged to JCPS investigators that Tinch had sex with her, attorney David Travis said. The accuser was not a student of Tinch’s, the lawyer said. “He’s never had any contact with her of any sort,” Travis said. Travis contends, most of the 102 text messages alluded to in a JCPS investigation report were sent by the accuser, who is a juvenile and has not been named. Most of Tinch’s replies were asking the sender to identify herself, the lawyer said. His client told investigators he believed most of the calls and texts were from a woman he had met at Louisville Billiards.

My number was saved in his phone.” She says after they had sex, Tinch wouldn’t leave her alone. “He just started calling a lot. He started calling more than 5 times in a row. I didn’t answer any of the phone calls. He showed up at my house at 3 in the morning” said the girl. She says she came forward because she just wanted him to stop.

Charges against Joshua Tinch, the former JCPS teacher and U of L athlete accused of having an inappropriate relationship with a student, won't be presented to a grand jury ... The Commonwealth Attorney's office says it did not have enough evidence to establish probable cause that a crime had been committed. It says that decision was made in October and was "reaffirmed" after it reviewed an investigative report JCPS submitted.

No charges will be presented to a grand jury in the case of a former University of Louisville athlete accused of having an inappropriate relationship with a student at the high school where he taught ... According to the Commonwealth Attorney's office there was insufficient evidence to establish probable cause against Tinch.
