Sulphur Springs Police Department Press Release (Nov 21 2012): On Monday, November 19, 2012 the Sulphur Springs Independent School District (SSISD) Police Department notified us that they had information that an educator had been having a relationship with a female student. Special Crimes Unit officers, Lt. Harold McClure and Detective Sergeants Mark Estes and Tony Crouse were assigned to investigate this serious allegation. As officers were interviewing the educator, SSISD teacher, Donnie Merle Martin, confessed to having sexual contact with a female student. On Tuesday November 20, 2012 at approximately 5:40 pm, Mr. Martin was taken into custody on a 2nd degree felony offense of having an improper relationship between an educator and a student and was transported to the county jail. Bond was set at 20,000 dollars! “PC21.12 Improper relationship between educator and student Amended 2009 (a)An employee of a private primary or secondary school commits an offense if the employee engages in: (1) sexual contact, sexual intercourse, or deviate sexual intercourse with a person who is enrolled in a public or private primary or secondary school at which the employee works; or (2) conduct described by Section 33.021, with a person described by Subdivision (1), regardless of the age of that person. (b) An offense under this section is a felony of the second degree. (b-1) It is an affirmative defense to prosecution under this section that the actor was the spouse of the enrolled person at the time of the offense. (c) If conduct constituting an offense under this section also constitutes an offense under another section of this code [Penal Code], the actor may be prosecuted under either section or both sections. (d) The name of a person who is enrolled in a public or private primary or secondary school and involved in an improper relationship with an educator as provided by Subsection (a) may not be released to the public and is not public information under Chapter 552, Government Code.”
